CAS introduces Spanish as its third official language / El TAS introduce el español como tercer idioma oficial

The Court of Arbitration for Sports (CAS) has amended the Code of Sport-related Arbitration effective as from 1 July 2020. Of particular interest is the CAS' decision to amend the provisions so as to take into account technical innovations and to allow the use of electronic filing and video-conferencing.

Furthermore, the revision considered an important practical reality, namely the frequent use of Spanish in CAS proceedings. Whereas previously the use of Spanish as the language of the arbitration was subject to the mutual agreement of all parties involved and of the arbitrator(s) in charge of the procedure, Spanish has now been introduced as the third official working language of the CAS, along with French and English.

According to recent available statistics, the CAS conducts more than 600 arbitration proceedings each year, 10% of which involve Spanish-speaking parties. Since the foundation of the CAS, over 400 arbitrations have been conducted in Spanish.

The CAS is seated in Lausanne, Switzerland, and has two permanent decentralized offices in Sydney and New York. The CAS has jurisdiction over sports-related disputes by operation of an arbitration clause providing for its jurisdiction. The disputes may either be of a commercial nature (e.g., contracts on sponsorship, television rights) or of a disciplinary nature (e.g., anti-doping and other disciplinary sanctions). Unless the parties have validly waived their right to challenge the award, CAS awards are subject to appeal before the Swiss Supreme Court.

In addition to Swiss arbitration law being applicable to all CAS proceedings, Swiss substantive law applies to the merits unless the parties agree otherwise.

El Tribunal de Arbitraje del Deporte (TAS) ha modificado el Código de Arbitraje Deportivo con efecto a partir del 1 de julio de 2020. Entre otras modificaciones, el nuevo Código permite la presentación de escritos por vía telemática, así como las videoconferencias.

La revisión también reconoce y recoge en el Código una realidad de los procedimientos ante el TAS, esto es, el uso del español como idioma del arbitraje. Mientras que anteriormente el uso del español como idioma del arbitraje estaba supeditado al acuerdo de todas las partes implicadas y del árbitro o tribunal arbitral, el nuevo Código introduce el español como tercer idioma oficial del TAS, junto al francés y al inglés.

Cabe precisar que, según estadísticas recientes, de los 600 procedimientos que cada año se inician ante el TAS, alrededor de 10% involucran a partes de habla hispana. Más concretamente, desde la creación del TAS se han realizado más de 400 arbitrajes en español.

El TAS tiene su sede en Lausana, Suiza, y dos oficinas descentralizadas permanentes en Sídney y Nueva York. Conforme al Código, el TAS conoce de las disputas relacionadas con el deporte que se le remiten en base a una cláusula de arbitraje que establece su jurisdicción. Las controversias pueden ser de carácter comercial y mercantil (por ejemplo, contratos de patrocinio, derechos de televisión, etc.) o disciplinario (por ejemplo, antidopaje y otras sanciones disciplinarias). A menos que las partes hayan renunciado válidamente a su derecho a impugnar el laudo, los laudos del TAS son susceptibles de recurso de anulación ante el Tribunal federal suizo.

Además de que la ley de arbitraje suiza regula todos los procedimientos ante TAS, el derecho sustantivo suizo se aplica al fondo de la disputa, salvo acuerdo contrario entre las partes.
